Terms of Service
Please read these terms carefully before using our services.

1. Agreement to Terms
By accessing and using Mudimedia Software's website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Service Description
Mudimedia Software provides professional software development services including but not limited to:
- Web application development
- Mobile application development (iOS and Android)
- Artificial intelligence and machine learning solutions
- Digital marketing services
- Software consulting and strategy
- Technical support and maintenance
3. Acceptance of Work
All projects are subject to written agreement between Mudimedia Software and the client. Work will commence only after:
- Signed service agreement or statement of work
- Receipt of required initial payment or deposit
- Completion of project discovery and requirements gathering
4. Payment Terms
4.1 Payment Schedule
- Payment terms are specified in individual project agreements
- Typical payment schedules include milestone-based or monthly recurring payments
- All invoices are due within 30 days of issue date unless otherwise specified
4.2 Late Payments
Late payments may result in project suspension and may incur additional fees. Mudimedia Software reserves the right to charge interest on overdue amounts at a rate of 1.5% per month.
5. Intellectual Property Rights
5.1 Client Ownership
Upon full payment, clients receive ownership of custom code and designs created specifically for their project, excluding any pre-existing intellectual property of Mudimedia Software.
5.2 Mudimedia Software Rights
Mudimedia Software retains rights to:
- General methodologies, processes, and techniques used in development
- Pre-existing code libraries and frameworks
- Knowledge and experience gained during project execution
6. Confidentiality
Mudimedia Software agrees to maintain the confidentiality of all client information and will not disclose any confidential information to third parties without explicit written consent, except as required by law.
7. Warranties and Disclaimers
7.1 Service Warranty
Mudimedia Software warrants that services will be performed in a professional manner consistent with industry standards. We provide a 90-day warranty on deliverables against defects in workmanship.
7.2 Disclaimer
Except as expressly stated herein, all services are provided "as is" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
8. Limitation of Liability
In no event shall Mudimedia Software be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.
Our total liability for any claim arising out of or relating to these terms or our services shall not exceed the amount paid by you for the specific service giving rise to the claim during the 12 months preceding the claim.
9. Project Changes and Scope
Changes to project scope must be agreed upon in writing by both parties. Additional work outside the original scope will be billed separately at our standard rates.
Clients are responsible for providing timely feedback and approvals. Delays in client response may affect project timelines and delivery dates.
10. Termination
10.1 Termination by Client
Clients may terminate services with 30 days written notice. Payment is due for all work completed up to the termination date, plus any non-refundable expenses incurred.
10.2 Termination by Mudimedia Software
We may terminate services immediately if:
- Client fails to make required payments
- Client breaches any material term of the agreement
- Client requests work that violates laws or our ethical standards
11. Data Protection and Privacy
We are committed to protecting your privacy and personal data. Please refer to ourPrivacy Policy for detailed information about how we collect, use, and protect your information.
12. Force Majeure
Neither party shall be liable for any failure or delay in performance under this agreement which is due to fire, flood, earthquake, pandemic, governmental action, war, terrorism, or other causes beyond the reasonable control of such party.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of the United Kingdom for our London office and the laws of Turkey for our İzmir office, depending on the primary location of service delivery.
14. Dispute Resolution
Any disputes arising from these terms or our services shall first be addressed through good faith negotiations. If resolution cannot be reached, disputes shall be resolved through binding arbitration in accordance with the applicable jurisdiction's arbitration rules.
15. Modifications to Terms
Mudimedia Software reserves the right to modify these terms at any time. We will notify clients of significant changes via email or website notice. Continued use of our services after such modifications constitutes acceptance of the updated terms.
16. Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.
